TERMS AND CONDITIONS OF UNDERSTANDING
1 . The Second Party should be sending the legalized formalities of Various Job Categories or Individual Demand Letters / Power of Attorney / Agreement which is attested & approved by Sri Lanka Embassy or Consulate Division in that relevant country , for the purpose of attaining Approvals from Sri Lanka Bureau of Foreign Employment to start dealing with the First Party which is operating the Manpower Recruitment & Supplying business in Sri Lanka.
i. In the event of Sri Lanka Embassy or Consulate is not exists in that particular country, also these attestation & approvals can be done in a nearest country which has Sri Lanka Embassy or Consulate Division by paying the legal & stamps fees or by paying that to Sri Lanka Bureau of Foreign Employment here in Sri Lanka.
ii. The Second Party should send all the attested copies via Email, and should send the Originals via international courier at no cost to the First Party.
2 . The Second party ( an Recruitment Agency or a Company ) should hold the responsibilities of finding and introducing of prudent and reliable Sponsors or the well-established Companies to the First Party & for the people going to be recruited under their reputed names.
i. Also the First Party can facilitate a Direct Dealing Agreement and can be done separately with the particular Companies / Factories / Services / Projects , without intervening of the Second Party.
3 . The Second Party is liable to send the Valid Visa or Work Permit & the Individual Contract Papers or any other Legalized Papers if needed for the selected candidates for their recruitments to the First Party for the purpose of making the selected candidates ready to travel and to take-up their Jobs.
4 . The First Party shall get the responsibility of choosing the correct suitable candidates and the placing of their applications to the Second Party and sending the selected persons after finishing legalized documents & procedures within the given time frame sooner than later to ensure compliance with the demand specifications and terms upon the particular agreements.
5 . The second Party should pay ( If it is needed.) the cost for the Advertisements in advance to find the suitable candidates for Skilled & Professional Job vacancies and their Officers or the Representatives has to be present in Sri Lanka if it is needed to conduct and carry-out the interviews in behalf of the Second Party.
6 . The Second Party shall pay the Air Ticket Fare cost to the First Party or send P T A for the selected candidates to arrive in intended destinations according to the particular conditions as applied in deferent dealing systems. ( This is not compulsory in all the dealings agreed & it can be varied.)
7 . The Second Party shall take full responsibility for the Post Landing services for the selected candidates upon their arrivals at the designated Air Ports and up to the intended working places for all the candidates from the First Party.
8 . The Second Party should pay the Agreed financial expenditure fees to the First party within a 03 working days in respective country , after the Arrival of the chosen person for the particular selected Job , for the manner of recruitment completed. The Second Party is liable to send the said financial expenditure fees through Banks to Banks or though Instant Money Transferring system from respective country to Sri Lanka .
i. Also if the First Party has to pay the financial expenditure fees to the Second Party for the recruitments completed , the Vise Versa of the same condition is applied as stated above.
9. The First Party shall hold the responsibilities about the Employees whose sent abroad for the recruitments for up to 03 months of period if a Deportation got occurred under Medical Grounds ( Not for Injuries or Sudden Sickness or Job Related Sicknesses.) or Violation of Job Agreements by the Employee or Refusing of continuation of the work as agreed in their contract papers approved by the Sri Lanka Bureau of Foreign Employment.
10 . The First Party shall not hold the responsibility if a Deportation got occurred under the Ill-Treatments / Harassments / Misuse / Negligence by the employer or by any other violation of the contract papers as agreed & stated prior to the commencement of the employment.
11 . The Second Party shall hold the responsibilities & make sure about the Recruited Employees well being and receiving of their Remunerations / Facilities / Perks , according to the agreed contract conditions. Also it is Second Party's responsibility to Change the Working Place of the Employee or sending back to Sri Lanka through Employer's Expenses If there is any malfunction occurred from the Employer's side.
12 . The Second Party shall take the vigorous responsibility to intervene and Solve the Complaints / Problems / Misunderstandings arising among the Employer & the Employee in the fact that the benefits for all the parties respectively.
13 . The First Party & The Second Party should act in accordance with the Agreements and the Job Contracts , which have singed individually & together with the candidates , whom are going to take up the Employments under the rules & regulations and the guide lines laid down by both countries or by relevant authorities respectively from the commencements of their employments and until the completion of their employments as agreed and stated.
14 . This executed M O U can be Re-adjusted or can be Changed Among the Particular Parties according to the Matters & Procedures arising from time to time under difference circumstances or conditions and it should be executed under the mutual understanding & interests of all the Parties in this agreement concerned.
This MOU is Executed in this _____day of ___________, ______ by mutual understandings and agreed conditions as stated.
